This privacy policy applies to the InCut app (hereby referred to as "Application") for mobile devices that was created by InCut Developer (hereby referred to as "Service Provider") as a Free service. This service is intended for use "AS IS".

The Application collects information when you download and use it. This information may include information such as

• Your device's Internet Protocol address (e.g. IP address)
• The pages of the Application that you visit, the time and date of your visit, the time spent on those pages
• The time spent on the Application
• The operating system you use on your mobile device

The Application does not gather precise information about the location of your mobile device.

The Service Provider may use the information you provided to contact you from time to time to provide you with important information, required notices and marketing promotions.

For a better experience, while using the Application, the Service Provider may require you to provide us with certain personally identifiable information. The information that the Service Provider request will be retained by them and used as described in this privacy policy.

The Application may share data with third-party service providers only as described in this Privacy Policy and only for the features the user chooses to use. These providers process data on behalf of the Service Provider and are required to provide the same or equal protection for the data they process, including equivalent confidentiality and security commitments.

When you choose Remove Background or Upscale and only after you explicitly agree inside the Application, the Application sends the selected image as image_url to fal.ai, a third-party AI image processing service, through queue.fal.run. The selected image may include faces, text, or other personal data visible in the image. The Application also sends the selected AI operation and the processing settings needed for that operation. Remove Background uses fal-ai/bria/background/remove. Upscale uses fal-ai/clarity-upscaler and includes the fixed prompt "clean, sharp, high quality mobile photo." fal.ai processes the submitted image and settings only to remove the background or upscale the image and return the edited result to the Application. fal.ai is required to provide the same or equal protection for submitted data, including equivalent confidentiality and security commitments. You can withdraw AI photo processing data sharing in Settings. When disabled, the Application will not send new images to fal.ai unless you agree again.

When you use AI Chat and only after you explicitly agree inside the Application, the Application sends the text of each chat message, the chat_id created for the chat session, and the fixed system_prompt used to create the session to OpenRouter Chat proxy, a third-party AI chat service hosted on Railway infrastructure at freeopenrouterchat-production.up.railway.app. Message text may include personal data if you type it into the chat. OpenRouter Chat proxy processes the submitted chat data only to generate photo-editing suggestions and chat responses for you. OpenRouter Chat proxy is required to provide the same or equal protection for submitted data, including equivalent confidentiality and security commitments. The chat service may retain conversation context server-side by chat_id for continuity during the chat session. This data sharing is used only for the AI Chat feature. You can withdraw AI chat data sharing in Settings, which resets the local chat session and prevents new chat requests until you agree again.

Video trimming, muting, filters, aspect changes, and export are processed locally on the device with Apple AVFoundation. The Application does not send videos to fal.ai, OpenRouter Chat proxy, or any other third-party AI service for video processing.

The Service Provider may disclose User Provided and Automatically Collected Information:

• as required by law, such as to comply with a subpoena, or similar legal process;
• when they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
• with their trusted services providers who work on their behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. AI chat data sharing and AI photo processing data sharing can also be withdrawn separately in the Application's Settings screen.

The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. If you'd like them to delete User Provided Data that you have provided via the Application, please contact them at incut@gmail.com and they will respond in a reasonable time.

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information the Service Provider processes and maintains.

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

By using the Application and by enabling optional AI chat data sharing or AI photo processing data sharing, you are consenting to the processing of your information as set forth in this Privacy Policy now and as amended by us. Optional AI features do not send chat text or images to third-party AI services until you explicitly agree inside the Application.
